This Affiliate & Referral Partner Program allows approved individuals and organizations (“Partners”) to earn compensation by referring clients to Gay Vacation Travel and its affiliated brands, including MyBearCruise.com.

Partners may participate as:

• Travel Agents
   
• Referral Partners (Non-Agents)
   
• Influencers / Content Creators
   

Participation is subject to approval and compliance with the terms below.

• Must be properly licensed and affiliated with an accredited agency
   
• May sell and advise clients on travel products
   
• Earn commission as outlined at the time of booking
   

• Are not travel agents
   
• May only refer potential clients
   
• May not quote prices, collect payments, make guarantees, or offer travel advice
   
• Must not represent themselves as agents or employees of Gay Vacation Travel
   

• Each Partner is assigned a unique referral link and/or referral code
   
• Only bookings tracked through the assigned link or code are eligible for payout
   
• Gay Vacation Travel’s internal systems (including Tern CRM) are the sole authority for determining referral credit
   
• Manual overrides are not guaranteed
   

• Commission rates are disclosed per program
   
• Paid after final payment is received from the client
   

• Paid a referral bonus or marketing fee, not a travel commission
   
• Payment structure may be:
   
  • Flat fee per booking, or
     
  • Percentage of Gay Vacation Travel’s net commission
     
• Paid after final payment and completion of minimum travel requirements
   

💳 Payments are issued via check, ACH, or other approved method.

No compensation is paid if:

• The booking is canceled
   
• The client does not complete final payment
   
• The referral cannot be tracked
   
• Program terms are violated
   

All payments are subject to standard business accounting timelines.

Partners agree to:

• Promote honestly and accurately
   
• Use approved logos and brand assets only
   
• Avoid misleading claims, pricing guarantees, or false urgency
   
• Comply with FTC disclosure rules (e.g., #ad, #affiliate)
   

Spam, misrepresentation, or unethical marketing will result in termination.

Partners are responsible for:

• Reporting all income
   
• Providing required tax documentation (e.g., W-9 for U.S. partners)
   
• Paying all applicable taxes
   

Gay Vacation Travel does not provide tax advice.

Partners are independent contractors and not employees, agents, or legal representatives of Gay Vacation Travel or JB Executive Travel Inc.

Nothing in this agreement creates a partnership, joint venture, or employment relationship.

Gay Vacation Travel may:

• Modify compensation structures at any time
   
• Suspend or terminate participation without notice
   
• Withhold payment for violations or fraudulent activity
   

Partners may terminate participation at any time by written notice.

Gay Vacation Travel is not liable for:

• Lost income
   
• Indirect or consequential damages
   
• Third-party platform outages or tracking failures
   

Maximum liability shall not exceed unpaid earned referral compensation.

This agreement is governed by the laws of the State of Florida.
Any disputes shall be resolved in Broward County, Florida.

By applying to or participating in the Affiliate & Referral Partner Program, the Partner acknowledges that they have read, understood, and agree to all terms outlined above.

Influencer Partners agree to the following additional terms:

• Content must be truthful and reflect actual experiences
• FTC disclosure is required on all posts (#ad or #affiliate)
• No misleading pricing, urgency, or guarantees
• Gay Vacation Travel may repost influencer content with credit
• Hosted travel is discretionary and performance-based
• Influencers are compensated only for tracked bookings

Failure to comply may result in termination without payout.

Travel Agents

• 10%+ commission (program-specific)
   
• Paid after final payment
   
• Licensed agents only
   

Referral Partners (Non-Agents)

• $100 per cabin booked
   
• OR 3–5% of net commission
   
• Paid after final payment
   

Influencers

• $100 per cabin booked
   
• OR 8–10% of net commission
   
• Performance bonuses available
   
• Hosted travel possible for top performers
   

💡 All payouts are subject to tracking and booking completion.

Partners must clearly disclose their relationship when promoting:

• “I may earn a referral fee if you book through my link.”
   
• “#affiliate”
   
• “#ad”
   

Disclosure must be:

✔ Visible
✔ On the same post as the promotion

Failure to disclose violates FTC rules and program terms.
